CROSSTOWN CLASH HOTTEST FAN PHOTO CONTEST
OFFICIAL RULES
1.HOW TO ENTER. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. The “Crosstown Clash Hottest Fan Photo Contest” (the “Contest”) is being organized by Sun-Times Media Productions, LLC, the owner of the Chicago Sun-Times (“Sponsor”).
The Contest will run daily beginning on Monday, June 13, 2011 and ending on Sunday, June 26, 2011 at 11:59 pm (each a “Contest Day” and, collectively, the “Contest Period”).
Enter the Contest during the Contest Period by going to the website located at http://www.suntimes.com/win (“Web Site”), completely filling out an entry form, and submitting a hottest fan photo of yourself (a “Photo”), stating whether you are a Cubs fan or a Sox fan, and following the directions to submit the form. Entrant’s Photo must be of entrant, solely entrant’s own original work and must comply with Sponsor’s Submission Guidelines and Terms of Use which can be found at www.suntimes.com/aboutus. Entrants will be automatically disqualified if Sponsor, in its sole discretion, considers the Photo offensive or distasteful. Those who do not fill in all the required fields or provide all the required information or whose Photo does not conform with the guidelines set forth in these rules will be disqualified. All online entrants and voters must have a valid email address. Entrants acknowledge that by entering, the entrant’s name and Photo, if eligible, may be posted on Sponsor’s web sites or print publications (a “Posted Photo”). Entries or votes that are forged, altered, or mechanically reproduced will not be accepted and will be void.
Sponsor and its parents, subsidiaries and affiliates are not responsible for late, lost, delayed, unclear, unintelligible, incomplete, misdirected, stolen, ineligible or damaged entries which will be disqualified or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in the Contest which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in the Contest. The computer clock of Sponsor is the official timekeeping device of the Contest.
2.ELIGIBILITY: The Contest is open to legal residents of Illinois, Indiana, Wisconsin and Iowa aged 21 years or older, except employees of Sponsor, its parent and affiliated companies, advertising agencies, and promotional partners), and relatives of and those living in the same household as such employees. For the purpose of this Contest, relatives are defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren. All federal, state and local laws and regulations apply. Void where prohibited.
3.SELECTION OF WINNERS: Readers of Chicago Sun-Times and visitors to suntimes.com will be asked to vote for their favorite Posted Photos during the Contest Period at www.suntimes.com/win . Limited to one vote per person per day. At the end of the Contest, the Cubs Fan and the Sox Fan who each have the most votes will be selected as the winners of the grand prizes and in the case of a tie, the winner will be selected at random from the tied entrants. Also, one random entrant from all eligible entries with Posted Photos will be selected to win the first prize. Each winner will be notified that they may have won a prize in this Contest by telephone. Winners may be required (in Sponsor’s sole discretion) to sign and return an affidavit of eligibility and liability/publicity release (which is subject to verification by Sponsor) within the time frame specified by Sponsor or the prize may be forfeited. If any prize notification, prize, or Contest communication is rejected or returned as undeliverable or if a winner cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), such winner may be disqualified. Each winner’s name and photo may be published in the Chicago Sun-Times newspaper or on its website.
4.PRIZES/ODDS: At the end of the Contest, there will be:
Two (2) grand prizes awarded, consisting of 4 Chicago Cubs vs. Chicago White Sox Rooftop tickets for the July 1, 2011 game (the “Event”); and
One (1) first prize awarded, consisting of: 2 rooftop tickets to the Event.
Approximate retail value (ARV) of each ticket: $200, ARV of all prizes: $2,000. Odds of winning depend on number of eligible entries received and quality of the Photo submitted. All prizes legitimately claimed will be awarded. All federal, state and local taxes, as well as any expenses not specified in these Official Rules, are the sole responsibility of the winner. No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute the stated prize with another prize of equal or greater value should the stated prize become unavailable. No more than the stated number of prizes will be awarded.
If any winner cannot attend the Event, he/she will forfeit the prize in its entirety and Sponsor will have no obligation to provide any sort of substitute. Actual seats at the Event will be selected by Sponsor in its sole discretion. All gratuities, travel expenses, taxes, ground transportation and other expenses not specified in these official rules are the sole responsibility of the winner. All participants understand and agree that the Event is subject to cancellation or rescheduling and that Sponsor will have no liability for any such occurrence.
By entering this Contest and accepting a prize, each winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest activity, including attendance at the Event. Each winner understands and agrees that Sponsor and its agents reserve the right, in their sole discretion, to disqualify and remove any prize winner or his/her guest(s) from any activity at any time if such prize winner or his/her guests’ behavior at any point is disruptive or may or does cause damage to person, property or the reputation of Sponsor.
5.LIMITATION OF LIABILITY: By entering, entrant agrees to release, defend, hold harmless and indemnify Sponsor and its parents, subsidiaries, affiliates, contractors, directors, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) any damage to entrant's cellular telephone or computer relating to or resulting from entering or downloading materials or software in connection with entering this Contest; or (ii) any injuries, losses, or damages of any kind caused by the acceptance, possession, use or misuse of a prize awarded in the Contest, including but not limited to any claims for damage to property, personal injury, death or claims based on defamation, rights of privacy, rights of publicity or merchandise delivery. False or deceptive entries or acts will render the entrant ineligible. WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for any printing or typographical errors in these Official Rules or any other materials associated with the Contest. Entrants enter at their own risk and Sponsor is not responsible for and shall not be liable for any condition caused by events beyond their control that may cause the Contest to be disrupted or corrupted. Failure to comply with these Official Rules may result in disqualification from this Contest. Sponsor reserves the right, in its sole discretion, to void entries of any entrants or voters who Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Contest. Participants further agree to not knowingly damage or cause interruption of the Contest and/or prevent others from participating the Contest. Any person who supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these official rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law. Sponsor reserves the right to permanently disqualify any person it believes has violated these Official Rules.
6. GENERAL RULES: By entering the Contest (except where prohibited by law), entrants consent to the use of their names, pictures, Photo, likenesses, voices, biographical data, and/or any information contained in their entry in advertising, promotion and marketing materials throughout the world, including on the internet, by Sponsor, its promotional partners, and third party marketing entities, without additional compensation, notification, review, or approval. Sponsor’s decisions will be final in all matters related to this Contest, the interpretation of these Official Rules and awarding of the prizes. If the Contest is not capable of running as planned for any reason, Sponsor reserves the right, in their sole discretion, to cancel, modify or suspend the Contest and award the prizes from among entries received prior to or after the date of the cancellation, modification or suspension. DO NOT call Sponsor or its promotional partners, as this Contest will not be discussed by phone, except at the Sponsor’s sole discretion.
7. WINNERS’ LIST. For the name of the winners, send a legal-size, self-addressed, stamped envelope to: “Crosstown Clash Hottest Fan” Winners’ List, 350 N. Orleans St., 10th Floor, Chicago, IL 60654. Requests must be received no later than three (3) months following the close of the Contest.
